enrolled in health insurance plans through the federal exchange in november. that, according to a source familiar with the numbers, that is up from the mere 27,000 who signed up through the federal xhafrpg in october. the source tells nbc news the administration still expects most enrollment will occur towards the end of the six-month signup period which expires on march 31st. we're waiting for the latest update from the white house press secretary jay carney scheduled to begin his briefing any moment mao. on a conference call with reporters, the man in charge of fixingth healthcare.gov website said the difference between october first and now is like night and day. >> response times are under 1 second. error rates are down well under 1% and the system is stable with uptimes exceeding 90%.

>> the white house insists the health care website can handle 50,000 users at one time and 800,000 users per day. joining me now, capitol hill correspondent luke russert. some of the other numbers coming out, they've worked on 400 different software issues related to the slowdown here. i think for the most part at least so far, people are describing this as significantly better. we're not seeing a barrage of reporters trying to get on the website. this pif ots to the issues of the politics. i want to read john cornyn said, the website is the least of obama care's problems. now are shifting about the complaining of the website and slow moving site to the policy and their disdain for this program. >> reporter: very true. we're going to see them tocontie to do that in the house of representatives, the house ways

and means on health care, administration officials where they'll move forward with concerns regarding what they believe is the misleading claim by democrats and you got it, you like it, you keep it. this website news is real welcome news for a lot of house democrats for a long time felt that the administration hung them out to dry. remember, a lot of folks in 2010 lost their jobs over this law. this website to be up and running, it makes it at least more politically viable because you can say while there may have been problems in the get-go, at least people are getting health care and getting those life saving benefits. what's going to be interesting to see going forward, what's the next gop line of attack on the law? they've done everything they can to delay the implementation. you got it, you like it you keep it, happened before thanksgiving. do we go into christmas with real attacks on certain areas of it? it seems like all of the stuff you can do about the website, god willing for democrats is

probably over, but who knows as the day goes on. it will be interesting to see what the new line of attack will be. they can go into more personal stories about people losing health care coverage because the plans aren't covered by new changes and they think unless there's a massive enrollment towards the six-month period, he'll have a lot to work with. what will be most interesting, where do new enrollments come from, places like california and new york receptive to that or get the federal website up and running in states like oklahoma and louisiana that have not been so receptive to this as the other ones. >> to your point, those are all great points, to present and where the next line of attack will come from, some people believe it will be the issue of privacy. we know mike rogers has been hitting that issue heavily believing that some of this information is being put in, not being protected. i want to play a little pushback from sunday morning programs from the republicans who were on

those shows. let's play it, please. >> you never get a second chance to make a first impression. first impression here was terrible. i think it's going to be an unfolding disaster for the president. >> bewe've broken the system to fix a few. nobody would fix a problem that way. >> what are you hearing from democrats regarding as some of them have been described as skittish over the past few weeks? many of them are sticking to their line, this is a bad law from beginning to now -- what are you hearing from republicans -- democrats? >> reporter: once people understand it and get the benefits, they like it but that is predicated upon it working. you can read stuff out of kentucky, conservative folks who never had health care, this is wonderful, we like these types of things. as long as the perception is out there that somehow you're being infringed upon, it's problematic. on that point you brought up, it's very important what mike rogers about security.

there's going to be issues like that that trickle out over the next couple of months. there was one beforehand going across conservative blogs that possibly convicted felons could be getting private information by how you sign up. there's going to be little turn-off issues like that. the supreme court is hearing the contraception issue regarding the health care law in the spring, mid summer. that brings the law into focus again in 2014 on an issue that is very divisive for a lot of people. >> let me bring in javier mesaro. thank you for your time. >> good to be with you. >> you've got another hearing this week. we start the week off with positive news at this point regarding the health care website. jay carney says they have seen improvement but more work is to be done here. we know that but how do you assess where democrats stand,

particularly like yourself? you were concerned and at one point suggested that heads should roll after what happened. >> it's a building process. what we want to do is have something that works. there are millions who need good insurance the way you probably have it and i have it. the real goal is to make sure no american ever has to file for bankruptcy because you took your son or daughter to the hospital. i think the administration is very focused and the website is working. i have gone on the exchange to get my insurance and find if you -- if you're a little patient, it will work. the most important thing is to have stories, whether it's a story of andrew in california who saved $6,000, took him three hours to get through the website but saved $6,000, those are stories you want. >> as luke pointed out, you have people who have the counter story that they are paying more,

that they are not able to keep the insurance, that he they had all along which is the focus of the hearing that luke pointed out. i do want to point out something regarding the rollout. this is a soft launch. we're expecting to see ad buys from the government and insurance companies and one of the strategies that the new york times points out, officials want to focus on areas like texas, florida and illinois. these are states with a high concentration of uninsured people. the number they point out is that there are ten counties that have 18% of the nation's uninsured and california being one of the focus there. >> my district in los angeles has one of the largest numbers of uninsured americans in the country. and it's because these are folks who work very hard but don't earn very much. it's tough for them to afford policies that were available in the past. now they are finding that they'll be able to afford policies and getting on. that's the beauty of the system

when it works. that's why we want to continue to build to make sure it works. the goal is to make sure everyone has a chance to have a story like andrew where they save a lot of money and don't spin wheels getting coverage for their family. >> speaking of spin, back to how we move forward, there's so much focus on 2014. can the democrats stay in line and support the aca, support the president and the website, and how do you counter, which has been widely reported will be the strategy of republicans to point any and every flaw, glitch, mistake, whatever you choose to call it, leading up to the midterms, are democrats prepared to stand strong and avoid the skittish part of the party last week? >> tamron, we saw this done to social security and medicare. they threw everything including the kitchen sink at social security when it first started. same with medicare. they said it was communism and would never work. today millions of americans are not only benefitting from social security and medicare but fighting to keep it. the same thing was said about

romney care in the state of massachusetts, where they have a similar program, the affordable care act was modeled on romney care in the state of massachusetts where nearly every single massachusetts resident has health care. what we got to do is fix the website, make it work, build upon it and then let the chips fall where they may on politics. >> thank you so much, congressman. it's always a pleasure to speak with you. thank you again. >> thank you. >> let's bring in our "news nation" political panel. wendell potter, author of obama care, what's in it for me. senior white house reporter for politico and luke chung, founder of a software development firm located in virginia. thanks for joining us. i wanted to start with you luke, you were quoted in an article about the administration and what this website should be able to do here. now today the latest concern is the back to front, what's happening on the so-called back

end, meaning the information people can get on now and the distribution of the information and the details to the insurance companies here. how does the administration fix it from now front to what we're now talking about, the back portion of this? >> that's been the big challenge for the whole administration during the process, to get consumers through the marketplace to choose something they want, apply for a subsidy and there are a lot of steps in there that need to work correctly so that people essentially can work through that whole -- >> that's part of the concerns we're hearing today from the insurance industry wendell, this back end information, that's supposed to deliver consumer details to insurers have not been fixed and as a result people will not give information they need in the 30 days of scheduling their insurance. what can the insurance industries do to assist in this

or is that even their role? >> they will continue to be meeting with white house and administration officials to make sure that things are fixed by the time people are able to exercise benefits with new policies. they are also going to be pressing to see if they can work separately from the website, separate from healthcare.gov, maybe with the irs or social security administration to verify that they are indeed citizens or have social security numbers and if they are eligible for benefits. they qualify from an income perspective, you'll see quite a bit of that. >> the other thing we're waiting to see, this push, hard push from the administration as i said already in the show, they refer to as a soft launch. our first read team points out the things to work for in the next two months, the insurance companies and government beginning to air their multimillion dollar tv ad campaigns? and the second is about democrats to see those particularly in the red states.

will they be more secure in their standings leading up to 2014? wendell, as i pointed out to congressman becerra, a few states have a high concentration of uninsured as pointed out by the new york times, 4%, half of the uninsured in this country live in 4% of all counties. again, texas, one of those states where lawmakers are pushing back heavily against the health care law. >> i think you'll start seeing though that a lot of the -- insurance companies will be advertising probably within the next week or two, certainly by mid december because they'll want to make sure they are getting people enrolled by the 23rd and will not want to wait until the 23rd. they don't want to have so many people it will crash the website again. we'll start seeing advertising from the insurance companies starting within a matter of days. >> let's get to the politics of it. you and i both know that there

were many strong supporters of the president who said as this website improves there will be no too little change from republicans who will oppose this law until the very end here. i think that's exactly what you're seeing. one story line, yes, there are improvements and things are running better but you speak to the republican, so what, you have bigger issues than the website? >> i think the tweet from john cornyn who is in the republican leadership was very telling where he said it doesn't matter its working better, there are so many other problems. to a certain extent he's true and the white house acknowledges that there are many, many challenges ahead for them. but the website now that it's fixed, republicans are saying privately over the last few weeks trying to pivot away from the sole focus on website understanding that one day it would be fixed and they have to move on to other lines of attack. i think that's what we're going to be seeing now.

they have a long list of issues they are going to bring up against the aca. some of them will get traction, particularly the back end issues. website, the white house is aware that is a big problem, big challenge coming up getting those issues worked out. we'll hear more stories from people who are finding out they are not covered when they thought they were or going to the doctor and not knowing that there are -- may not have that information. that happened before with other health care programs, once you help through that it may not be an issue and it's a potential line of attack for republicans. >> that's been the perilous position for republicans, you point out it's the website that's the problem. when the website is fixed or when it starts to improve, it becomes the then what. i think you have people watching at home and these enrollment numbers the latest ones anyway, prove that you have a great number of people who at least are interested and want some type of health care here. you have a situation where you pivot back to the republicans of

the then what and what's your best offer if you just don't like the notion of the affordable health care act. >> for republicans it's a race against time. the reason they push so hard in october against aca is because that was when the website was being stood up. people will start receiving benefits. again, it's a race against time starting january, benefits will be received by people. it gets increasingly harder to start taking that away politically. so we're going to see continued attempts by republicans to weaken it over the next month, nowing that they are running out of time because at some point public relationswise it may be difficult for them. >> lastly in the article you were quoted in the times, you said it was not unreasonable to expect 50,000 users to be on at the same time. this was the government's goal. they reached that. what is the reasonable expectation as it stands now, what people should expect moving ahead with these slight improvements that we're seeing? >> well, i'm really hoping as a

user and taxpayer that the system works properly. you know, as of today i still haven't been able to log into the system because it's been too busy. i'm not sure about the changes they've made. but they are still talking about error rates and i'm not really sure how you deploy a website with known levels of errors, applications, either work or they don't work. i'm not sure they are still in a state where they are expecting 1% of the people to fail for unknown reasons or people who enter in certain things they know will fail and only expect 1% of the people to do that. >> you said you attempted to get on today and you were unable to do so? >> correct. >> was this your first time trying to get on the website? >> i've been trying since the weekend. i've seen some improvements where they created a whole new area which could give you an estimate for unsubsidized prizing based on age and

demograph demographics, however they have a button where you can press to apply and it sends you back into the system to log back in. you're not getting a subsidy. >> you don't count that as getting on the website? you're describing things that go beyond error message. >> that's a step forward. but i still didn't see the way to actually buy. for instance, if you don't need a subsidy, why do you need to be in the system anymore, it needs to be siphoned off directly to the insurance company. >> at this point the white house says 375,000 visitors have gone on to healthcare.gov. monday by noon, the new number, luke, that the jay carney just cited, 375,000 since noon. that is an unimpressive number to you speaking as a person who tried to get on and technical background? >> those are very manageable numbers for modern websites. that's great. i'm sure lots of people will be getting on to shop as they would

on black monday or any other e commerce website. they need to shop and compare. they've done better things in comparing plans but this is a long, drawn out process, isn't buying a book on a website. people need to examine these plans carefully. >> just as you did when i signed up for my health care. if you've ever gotten a job where you have health care, we all know you turn to the person in the cubicle next to you and do you understand what's going on here? that is across the board if you've ever filled out, government or not, any insurance form for any company. >> absolutely. it's not a one click process. the marketplace is really important. >> thank you very much for your time. i really appreciate it. we'll see what tomorrow brings, of course. coming up -- authorities have confirmed four people dead, more than 60 injured. we're getting new details on fatal train crash in new york.

today federal officials have begun removing data from two black boxes recovered from the wreckage of the deadly train derailment in new york city. four people were killed and more than 60 others injured when the commuter train spun off the tracks while taking a sharp turn into the bronx. the national transportation safety board tweeted this picture of investigators downloading data from one of those recovered boxes. officials believe speed was a factor in the crash and the train's engineer told first responders that the brakes failed as the train approached the curve, which has a speed limit of 30 miles per hour. experts say that technology already exists that could potentially prevent accidents like this one. a system called positive train control or ptc uses sensors and gps to track the trains movements. a computer can acty vat the breaks if they are going too fast. amtrak is already using it on some lines but congress wants to mandate it on many lines by

2015, including metro north, the line involved in yesterday's deadly derailment. here's how survivors of the crash describe the chaos in the moments before and after the accident. >> as we were going over, i looked at my two and screamed at my two friends that were going over. i couldn't believe it. i was in shock. >> it was when it went around the curve, i actually looked up. i knew it was going way too fast. >> screaming and people crying out, god and asking for families. it was pretty gruesome. >> kristen dahlgren has the latest on the investigation. what's the update on the two people in control of the train who are being interviewed here? >> reporter: yeah, the conductor and engineer, ntsb had planned on speaking with them today. we don't know if they've been able to do that. they will hold a briefing at 4:00 p.m. eastern time. we should know more then. let me show you what's going on here right now.

you can see those cars have now been righted. there are just two of them left here on the track. they've been move the back on the tracks and moving them away from here. that will let investigators have access to look around them and see if there's anything peculiar about the cars to see if they can recover any type of information about what may have happened and clears them out so they are able to look at the tracks to see if there's anything that may have contributed to that as they are still waiting to speak with the engineer, waiting to hear the results of that. and they are also talking to witnesses, people who were on the train to find out what it was like for them. >> we asked the governor about all of this on the "today" show. >> i think it is going to be speed related. this was a tricky turn on the system but it's a turn that's been here for decades and trains negotiate all day long.

it's not about the turn. i think it's going to turn out to be about the speed more than anything and the operators, operation of the train at that time. >> reporter: that turn where a train needs to go from about 70 miles per hour down to about 30 miles per hour. so tricky turn. the governor pointing out that trains have been making that turn for quite some time. this is the first time we've seen a derailment in this exact place. meanwhile, we're also learning more about the conditions of the patients. we were updated by hospitals, 27 patients have been treated and released and at least three remain in critical condition at this hour. >> thank you, kristen. >> coming up, the rnc tweets that racism has ended in a message meant to honor rosa parks. now they are walking that back after a lot of backlash. up next, you know by now it's cyber monday.

from ups to toys "r" us. >> tamron, the volume of malicious e-mail has been going up steadily during the fall and it's pretty much going through the roof right now. many of the viewers might have seen some of this come through. a lot of it comes in the form of greeting cards or coupons or offers for free gifts and especially what's really popular are these shipping documents that come from fedex, dhl, you name it, amazon. >> fake delivery confirmations saying your box was delivered or your box cannot be delivered, click here? >> exactly. the spoofs are very well executed and been doing this for years now and that's where the one in ten comes in. as long as one in ten clicks on it, essentially they'll set an infection that takes over control of the computer.

>> why do you believe this is an unprecedented year for it, this cyber monday? >> because if you think about how we live our lives, we're much more into mobile and into social media and those are just two new huge new paths that the bad guys can take advantage of. and they are doing that. moving more into shopping -- using mobile devices to compete -- to both shop and complete the transaction. so the security companies tracking the bad stuff across the internet are indeed seeing malicious attacks going in that direction. >> it's interesting in your article you quote a couple of people. one who said we're human so we feel compelled to click, if it's from a delivery agency, we know we didn't deliver from that particular company and we also trust our mobile devices when we're shopping because we believe since we're the only person who can touch it that somehow there's safety there

according to one of the cyber security strategists you spoke with? >> yeah, if you think about in your own experience how true that can be. i got one from a colleague, a fellow reporter, and i almost clicked on it. but what i saw is it came from his yahoo! act and the link was jiberrish and wasn't expecting anything from him. alerted to him that somebody has probably got a hold of his yahoo! account and going into his address book to spread malicious links. bad guys are corrupting e-mail accounts but also going in and corrupting facebook accounts and twitter accounts. doing it at skill because they can, it's cheap and easy to do. >> 131 million people expected to go online this cyber monday. so if as you pointed out this is unprecedented. that leaves a lot of people for cyber crooks to take advantage

to the upcoming deadline on the federal budget, paul ryan have 11 days to craft a new budget plan. if they fail, the federal government will face a second round of automatic spending cuts and yet another possibility of a shutdown early next year. today our first read team says both sides are optimistic but that talk of a so-called grand bargain no longer on the table. what's being debated between ryan and murray is a very small deal. joining me live now, senior political editor mark murray. i guess you have to get something done small because it seems a lot of bigger things, things that many people thought would move right along have not. >> that's right.

after the government shutdown that we had back in october, tamron, probably is the sensible thing to set your sights very low. that seems to be what's going on right now. there is a lot of optimism on capitol hill. it seems all players and everybody want some type of deal. the chatter i'm hearing is that there are issues that need to be resolved but things look bright, at least get a baseline spending number that is the number that would fund the government for 2014. and also, the question is, what do you do about the sequester? is there some type of deal in training to mitigate some of those spending cuts? >> and also, one of the other storylines as we get to the end of the year, ineffectiveness of congress. it's not possible timewise, the clock has run out. >> that's right. now, it is important to know the congress does last until 2014. there is still a possibility of immigration reform. but right now, december 2013,

tamron, this congress doesn't have anything to show for it other than resolving a government shutdown that lasted 16 days to be able to extend the nation's borrowing limit to just a couple of months. outside of that it doesn't have much to show for it. all of the work getting done, this congress really hasn't been able to tie its shoe laces. >> looking forward to the next year, it seems it's dreadful in that we're not seeing a change in tone of particularly from republicans on some of the things that many people thought we would see, particularly immigration reform. >> that's right, tamron, the one thing we'll look for is that change is possible. the tone that you have right now can be very different two months later. there are all of these events and circumstances that can change things. there are people hoping as bad as 2013 has been for all of the political players, 2014 is a better year. >> let's hope so. thank you very much. we appreciate it, mark. >> now to colorado where the
